Welcome to the Pharmasys Solutions LLC website (“Pharmasys,” “we,” “us,” or “our”). By accessing or using this website (the “Site”), you agree to these Terms and Conditions (“Terms”). If you do not agree, do not use the Site.
1) Use of the Site

3) Consulting Services and No Guarantee of Outcomes
Pharmasys provides healthcare consulting services, including pharmacy regulatory compliance, licensing support, new pharmacy setup, and outpatient clinic/ASC consulting. Any services you purchase will be governed by a separate written agreement, scope of work (“SOW”), proposal, or service description as applicable.
Regulatory decisions are made by third parties (e.g., California Board of Pharmacy, DEA, CMS, commercial payers). We do not guarantee approvals, timelines, outcomes, or the actions of third-party agencies.
4) Booking, Payments, and Checkout
The Site may allow you to book consultations and pay online (including through Wix Bookings and/or third-party payment processors). By booking or purchasing, you agree to:

Follow any additional terms presented during checkout or booking
Payment processing may be handled by third-party providers. We do not store full payment card numbers.
5) Cancellations, Rescheduling, and Refunds
Policies for cancellation, rescheduling, and refunds may vary by service type and will be disclosed at booking/checkout and/or in your SOW or invoice.
Unless otherwise stated in writing:

Rescheduling: You may request to reschedule by providing at least 24 hours’ notice before your appointment time.

Late cancellations/no-shows: Appointments canceled with less than 24 hours’ notice or missed without notice may be charged in full or considered non-refundable.

Refunds: If a refund policy or money-back guarantee applies to a specific service, it will be stated on the Refund Policy page and/or in your SOW. Where permitted, refunds are limited to the terms disclosed for that service.
Pharmasys reserves the right to reschedule due to emergencies, illness, or circumstances beyond our control. If we must reschedule and you cannot accommodate, you may request a refund for the affected prepaid appointment.
6) Intellectual Property
All content on the Site—including text, graphics, logos, downloads, and design—is owned by Pharmasys or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from Site content without our prior written permission, except for personal, non-commercial use.
7) User Submissions and Confidential Information
If you submit information through the Site (forms, booking details, email), you represent that the information is accurate and that you have the right to share it.
Do not submit protected health information (PHI) or other highly sensitive information through website formsunless we have explicitly provided a secure method for doing so. If PHI is necessary for an engagement, we will coordinate appropriate secure channels.
8) Third-Party Links and Tools
The Site may include third-party tools and links (e.g., scheduling, maps, payment processors). We do not control third-party services and are not responsible for their content, availability, or privacy practices. Your use of third-party services is subject to their terms and policies.
9) Disclaimer of Warranties
The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Pharmasys disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
10) Limitation of Liability
To the fullest extent permitted by law, Pharmasys will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, your booking/purchase decisions, or reliance on Site content.
To the fullest extent permitted by law, Pharmasys’s total liability for any claim related to the Site will not exceed the amount you paid Pharmasys for the specific service giving rise to the claim during the three (3) months preceding the event giving rise to liability.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11) Indemnification
You agree to indemnify and hold harmless Pharmasys, its owners, affiliates, and contractors from claims, damages, liabilities, and expenses (including reasonable attorney fees) arising from your use of the Site, your violation of these Terms, or your infringement of any third-party rights.

Your use of the Site is subject to our Privacy Policy, which explains how we collect, use, and protect information.
13) Changes to These Terms
We may update these Terms at any time. The “Effective Date” above reflects the most recent revision. Your continued use of the Site after changes are posted means you accept the updated Terms.
14) Governing Law and Venue (California)
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute arising under these Terms will be brought in the state or federal courts located in California, unless otherwise required by law.
